Welcome to SnarkShot! These Terms of Use ("Terms") govern your use of the SnarkShot mobile application ("App") operated by SnarkShot ("we," "our," or "us"). By downloading, installing, or using the App, you agree to be bound by these Terms.

1. Use of the App

SnarkShot is an AI-powered caricature generation app. You may use the App to create caricatures from your photos for personal, non-commercial use. You agree to use the App only for lawful purposes and in accordance with these Terms.

2. Account & Registration

The App automatically creates an anonymous account for you. You are responsible for maintaining the security of your device and account. We are not liable for any loss or damage arising from your failure to protect your account.

3. AI-Generated Content

Caricatures are generated using artificial intelligence (OpenAI). You acknowledge that:

• AI-generated images may not be perfectly accurate representations
• Results may vary and are influenced by the quality of the uploaded photo
• We do not guarantee specific results or outcomes
• You own the caricatures generated from your photos and may use them for personal purposes

4. Acceptable Use

You agree NOT to use the App to:

• Upload photos of people without their consent
• Create content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
• Generate content that infringes on any third party's intellectual property rights
• Attempt to reverse-engineer, decompile, or disassemble the App
• Use the App for any commercial purpose without our written consent
• Interfere with or disrupt the App or its servers

5. Subscriptions & Payments

Free Tier

You receive 1 free caricature generation. No payment information is required.

Pro Subscription

• Pro subscriptions are billed weekly through Apple's App Store or Google Play
• Payment is charged to your App Store or Google Play account at confirmation of purchase
• Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period
• You can manage and cancel subscriptions in your device's account settings

Refunds

Refunds are handled by Apple or Google according to their respective refund policies. We do not process refunds directly.

6. Intellectual Property

The App, including its design, code, features, and branding, is owned by SnarkShot and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the App without our written permission.

7. Privacy

Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.

8. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components.

9. Limitation of Liability

To the maximum extent permitted by law, SnarkShot shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including but not limited to loss of data, loss of profits, or business interruption.

10. Indemnification

You agree to indemnify and hold harmless SnarkShot and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the App or violation of these Terms.

11. Termination

We may terminate or suspend your access to the App at any time, without prior notice, for conduct that we believe violates these Terms or is harmful to other users or the App.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms in the App. Your continued use of the App after changes are posted constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by and construed in accordance with applicable law, without regard to conflict of law principles.
